Kuwait Medical International, in cooperation with Taher Group Law Firm, organized an educational training course for its doctors and staff, as well as employees of its affiliated centers (Berlin Center, Jahra Center, Dima Center, Lausanne Center, and Al-Jarallah German Specialized Center), focusing on professional medical errors. The course aimed to define and clarify the concept of medical errors from both legal and professional perspectives.

On this occasion, Dr. Mohammad Al-Jarallah, Chairman of the Board and former Minister of Health, stated that the course aims to provide the latest information in the field of medical errors and to introduce modern methods for preventing and minimizing them through a scientific and structured approach.

For his part, the company’s CEO, Dr. Ali Mehdi Zadeh, delivered a detailed presentation on the company and its affiliated centers, outlining its policies and strategy, as well as its commitment to providing diverse educational training programs to enhance the skills of its workforce.

Subsequently, Lawyer Abdulaziz Taher AlKhateeb presented a comprehensive overview of the fundamental principles of legal liability and their application to professional medical errors. He highlighted the legal provisions regulating the medical profession under Kuwaiti legislation, including the conditions governing medical practice, the concept of medical error, and methods of proof.

Lawyer Khaled Taher AlKhateeb then reviewed key judicial principles and leading court rulings related to medical malpractice, in addition to discussing relevant jurisprudential opinions. He emphasized that both judiciary and legal doctrine have established that a physician’s obligation is one of due care rather than guaranteeing a specific result. He also noted that Kuwaiti courts recognize the importance of granting physicians confidence, reassurance, and professional discretion in their practice, and that medical negligence must be clearly and definitively proven in order to establish liability. Mere error, without negligence, does not give rise to liability.

In turn, Lawyer Fawaz Khaled AlKhateeb provided an in-depth explanation supported by practical case studies of medical and professional errors, referring to recent judicial rulings issued on the subject.

بهذه المناسبة، أكد د. محمد الجارالله، رئيس مجلس إدارة الشركة ووزير الصحة الأسبق، أن هذه الدورة تهدف إلى تقديم أحدث المعلومات في مجال الأخطاء الطبية، والتعريف بأفضل الأساليب العلمية المدروسة لتفاديها والحدّ منها.

من جانبه، قدم المدير التنفيذي للشركة، د. علي مهدي زاده، شرحاً مفصلاً عن الشركة والمراكز التابعة لها، مستعرضاً سياساتها واستراتيجيتها، ونهجها في تطوير كوادرها من خلال تنظيم دورات تدريبية تثقيفية متنوعة تسهم في تنمية مهارات العاملين.

بدوره، قدم المحامي عبدالعزيز طاهر الخطيب عرضاً شاملاً حول أهم قواعد المسؤولية القانونية وتكييفها على الأخطاء الطبية المهنية، موضحاً النصوص القانونية المنظمة لمهنة الطب في التشريعات الكويتية، وشروط العمل في المجال الطبي، إلى جانب شرح مفهوم الخطأ الطبي وطرق إثباته.

كما استعرض المحامي خالد طاهر الخطيب أبرز المبادئ القضائية والأحكام الصادرة في شأن الأخطاء الطبية، إضافة إلى الآراء الفقهية ذات الصلة، مؤكداً أن التزام الطبيب هو التزام ببذل العناية لا بتحقيق نتيجة، وأن القضاء الكويتي يحرص على توفير الطمأنينة والثقة والحرية للطبيب في مزاولة عمله، مع ضرورة أن يكون الخطأ أو الإهمال الطبي ثابتاً بشكل واضح وقاطع لإثبات المسؤولية، حيث إن الخطأ المجرد دون إهمال لا يُرتب مسؤولية على الطبيب.

واختتم المحامي فواز خالد الخطيب الدورة بتقديم شرح وافٍ مدعّم بحالات عملية لبعض الأخطاء الطبية والمهنية، مع استعراض أحدث الأحكام القضائية الصادرة في هذا المجال.
