Dr. Fawaz Khaled AlKhateeb, Assistant Professor at Kuwait International Law School, emphasized that cybercrime is among the most complex and high-risk categories of criminal activity, noting its rapid expansion globally and particularly within Kuwaiti society. He explained that cyber intrusions and electronic attacks targeting commercial companies and economic entities aim to disrupt systems, steal data and confidential information, and ultimately access financial assets, bank accounts, and other sensitive resources, in addition to various forms of online fraud and deception.

This came during Dr. AlKhateeb’s participation in a research paper titled “The Legal Implications of Cyber Attacks and Intrusions – A Criminal Perspective”, presented at the Third Annual Kuwaiti-British Conference on Cybersecurity (CERC-2021), held at Kuwait University’s College of Life Sciences. The conference was organized by the British Embassy in Kuwait and the UK Science and Innovation Network, in partnership with the Communications and Information Technology Regulatory Authority (CITRA), the Kuwait College of Science and Technology, and the Kuwait Foundation for the Advancement of Sciences (KFAS). The event aimed to enhance cybersecurity awareness and build national capacities.

Dr. AlKhateeb highlighted legislative shortcomings in modern legal frameworks and the challenges in effectively addressing cyberattacks and hacking crimes. He called on relevant authorities in Kuwait to prioritize the prosecution of high-risk crimes without overburdening law enforcement and investigative resources with disproportionate focus on cases related to freedom of expression.

He further stressed the importance of raising awareness of cyber fraud and intrusion risks and strengthening cybersecurity across judicial, investigative, and law enforcement bodies. He also underlined the need to enhance the technical capabilities of police agencies to keep pace with the evolving nature of cybercrime. Drawing on his legal practice, he noted that real case experience demonstrates the necessity of advancing the technical capacity of investigative authorities to effectively uncover and address such complex crimes.

Dr. AlKhateeb also urged immediate reporting of any suspected fraud or cyber deception affecting individuals, companies, and institutions, emphasizing the importance of cooperation and coordination among all stakeholders to achieve effective cybersecurity.

He concluded by calling for a reassessment of crime-fighting priorities, stressing that cybercrime, hacking, and online fraud should be classified among the most serious offences due to their technical complexity, transnational nature, and severe impact on individuals, businesses, as well as national economy and security. This, he said, requires continuous development of infrastructure and technical capabilities within security agencies.

أكد الأستاذ المساعد في كلية القانون الكويتية العالمية د.فواز الخطيب أن الجرائم الإلكترونية تعد من الجرائم المعقدة والعالية في الخطورة ونحن نشهد انتشارها وتوسعها في المجتمعات عامة والمجتمع الكويتي خاصة، فعمليات الاختراق والهجمات الالكترونية التي تتعرض لها الشركات التجارية والكيانات الاقتصادية تستهدف تعطيل الأجهزة الالكترونية وسرقة محتوياتها وأسرارها ومن ثم ممتلكاتها وأرصدتها البنكية وغيرها من عمليات الاختراق والنصب والاحتيال الالكتروني.

جاء ذلك خلال مشاركة د.الخطيب بورقة عمل بعنوان «الآثار القانونية للهجمات الالكترونية والاختراق - بعدسة جنائية» في المؤتمر البريطاني الكويتي السنوي الثالث والخاص بالأمن السيبراني (CERC-2021) والذي عقد في جامعة الكويت كلية العلوم الحياتية بتنظيم السفارة البريطانية في الكويت وشبكة العلوم والابتكار في المملكة المتحدة بالشراكة مع هيئة تنظيم الاتصالات وتكنولوجيا المعلومات في الكويت وكلية الكويت للعلوم والتكنولوجيا، ومؤسسة الكويت للتقدم العلمي، والذي يهدف الى تعزيز الوعي بالأمن السيبراني وبناء القدرات.

ولفت د.الخطيب إلى المثالب التشريعية التي تكتنف القوانين المعاصرة وصعوبات التصدي للهجمات الالكترونية وجرائم الاختراق، وطالب الجهات المسؤولة في الكويت بضرورة ملاحقة الجرائم عالية الخطورة دون استنزاف طاقات السلطات الأمنية وسلطات التحقيق بالتركيز غير المبرر على ما يتعلق بملاحقة الجرائم المرتبطة بالتعبير.

ولفت الخطيب إلى أهمية زيادة الوعي بمخاطر الاحتيال والاختراقات السيبرانية وتحقيق الأمن السيبراني، سواء لدى الجهات القضائية أو جهات التحقيق وجهات التحري مع أهمية تعزيز القدرات الفنية لأجهزة الشرطة المختلفة لمواكبة تطور الجرائم والتصدي لمرتكبي جرائم الأمن السيبراني، مقررا أن التجربة العملية في مجال المحاماة أتاحت قراءة قضايا مرتبطة بالأمن السيبراني يستفاد منها في الحاجة لتطوير الجانب الفني والتقني من سلطات التحري لكشف لغز وغموض تلك الجرائم.

وشدد د.الخطيب على ضرورة الإبلاغ عن أي شبهة نصب واحتيال قد تتعرض لها الشركات والمؤسسات والأفراد في المجتمع. وأكد على ضرورة التعاون والتنسيق بين الجميع وصولا إلى تحقيق الأمن السيبراني.

وختم د.الخطيب محاضرته بالتأكيد على وجوب إعادة النظر في أولويات مكافحة الجريمة ووضع جرائم الأمن السيبراني والاختراق والاحتيال الإلكتروني ضمن الجرائم عالية الخطورة باعتبارها جرائم معقدة يغلب عليها الطابع الاحترافي التقني العابر للحدود، كما أن لها انعكاسات خطيرة على كل من الأفراد والشركات وكذلك على اقتصاد وأمن البلاد، وهو ما يتحتم معه تطوير البنية التحتية والقدرات الفنية للأجهزة الأمنية.
