Assistant Professor of Law at the Kuwait International Law School and attorney Dr. Fawaz Khaled Alkhateeb stated that the Court of Cassation plays a fundamental and effective role in upholding freedoms. He added that although the judiciary is not typically praised, it must be acknowledged as the guarantor of rights and protections, through which the course of administrative authorities is corrected and adherence to the Constitution and laws is ensured. He stressed that safeguarding rights and freedoms is an urgent necessity.

Alkhateeb added, in a statement to Al-Qabas, that this contributes to maintaining social stability and protecting individual rights. He noted that “the right to freedom of movement is an explicit right under international law and human rights frameworks, and despite its clarity and incorporation into constitutions, security authorities still face challenges in understanding and properly applying it.”

He further explained that officials must distinguish between the right of sovereignty over territory and the individual right to movement, emphasizing that freedom of movement is guaranteed and protected, and constitutes a cornerstone of fundamental freedoms. The State may not interfere with or restrict this right except in cases prescribed by law.

Alkhateeb concluded by stating: “There are recurring instances of confusion between the right of sovereignty and the right to movement in many cases before the courts. Therefore, the State must carefully consider the rulings and principles established by the Court of Cassation and uphold rights accordingly. Respecting rights and freedoms benefits everyone and ensures the progress and prosperity of nations.”

قال أستاذ القانون المُساعد في كلية القانون الكويتية العالمية المحامي د.فواز خالد الخطيب: إن «محكمة التمييز لها دور أساسي وفعّال في تأكيد الحريات، ومع أن القضاء لا يشكر، إلا أنه يتعيّن علينا الإشارة إلى أنه الضامن للعدالة والحقوق، ومن خلاله يتم تصحيح مسار الجهات الإدارية وضمان التزام الدستور والقوانين، مشددا على أن صون الحقوق والحريات ضرورة ملحة.

وأضاف الخطيب لـ القبس: هذا يسهم في الحفاظ على استقرار المجتمع وحقوق الأفراد»، و«الحق في حرية التنقل هو حق صريح في القانون الدولي وحقوق الإنسان، ورغم وضوحه وإدماجه في الدساتير، إلا أن السلطات الأمنية تواجه تحديًا في فهمه وتطبيقه».

وأوضح الخطيب انه يجب على المسؤولين التفرقة بين حق السيادة على الأرض وحق المرور والتنقل للأفراد، قائلًا إن «حق التنقل مكفول ومحمي، وهو حجر زاوية للحريات الأساسية، ولا يجوز للدولة التعرض له أو تقييده إلا في الحالات التي يحددها القانون».

واختتم الخطيب بالقول «تتكرر حالات الخلط بين حق السيادة وحق التنقل في العديد من القضايا أمام القضاء، ولذا يجب على الدولة قراءة أحكام ومبادئ محكمة التمييز بعناية ومراعاة الحقوق، فاحترام الحقوق والحريات يعود بالفائدة والنفع على الجميع ويضمن تقدم الأمم وازدهارها».
