Criminal Court Acquits Expatriate of Money Laundering Charges in Case Involving Prison Sentences and Multimillion-Dinar Fines

Alkhateeb: Criminal liability is personal, and association with the facts of a case is insufficient to establish guilt

Kuwait’s Criminal Court has acquitted an expatriate of the charges brought against him in a high-profile money laundering case that attracted media attention and resulted in prison sentences and fines against several other defendants and two commercial companies.

The Court sentenced eight other defendants, in their presence, to 10 years’ imprisonment with hard labour and immediate enforcement, imposing fines of KWD 18 million. Two companies were also fined KWD 9 million and ordered to close permanently.

The acquitted defendant was represented by lawyer Dr. Fawaz Khaled Alkhateeb, Managing Partner of Taher Group Law Firm. The defence maintained that the legal elements of the charges against his client had not been established, that neither knowledge nor criminal intent had been proven, and that the funds involved originated from legitimate sources. The defence also challenged conclusions and inconsistencies in the investigations and financial reports concerning the client's legal position.

The defence pointed out that the investigations themselves had excluded his client from one of the acts attributed to the other defendants. It further maintained that the transactions in question were connected to genuine commercial activity and that the transfers examined during the proceedings had been conducted through a licensed foreign exchange company.

Dr. Alkhateeb stated that criminal liability is personal, and that merely being named in a case involving multiple parties is insufficient to establish an individual's criminal responsibility.

He added that, in complex financial cases, the evidence must independently establish the act, knowledge and criminal intent in relation to each defendant. This was the principle maintained by the defence from the outset of the proceedings until the acquittal was delivered.
