In a final ruling that could annul numerous health violation reports arising from procedural errors, the Court of Cassation upheld the judgments of the Criminal and Appeals Courts acquitting a health center of the charge of operating an unlicensed clinic, as the alleged violation was committed by individuals not authorized under the law.

The case arose when a Ministry of Health inspection team conducted a routine visit to a private clinic and identified alleged violations, including establishing and operating a private medical facility—a cosmetic and dermatology clinic—without obtaining the necessary license from the competent authority, the Ministry of Health.

Representing the clinic, Attorney Dr. Fawaz Alkhateeb argued for the annulment of the violation report, asserting that the report itself was invalid. He explained that the violation report was issued against the clinic for operating a facility without a license from the Department of Pharmaceutical Inspection at the Ministry of Health. However, according to the law, the authority to enforce the provisions of Law No. 70 of 2020 and issue related reports lies with the committee specified in the law, not the inspecting team that conducted the visit. Therefore, the report was signed in violation of the law and lacked proper jurisdiction.

في حكم نهائي قد يبطل العديد من محاضر المخالفات الصحية المثارة لخطأ إجرائي، أيدت محكمة التمييز حكم محكمة الجنايات والاستئناف ببراءة مركز صحي من تهمة فتح عيادة غير مرخصة، لارتكاب المخالفة من قبل أشخاص غير مختصين وفق القانون.

وتتحصل الواقعة عندما أجرى فريق وزارة الصحة جولة تفقدية على عيادة خاصة، وتم الكشف عن مخالفات منها إنشاء وتشغيل منشأة صحية خاصة، وهي عيادة تجميل وجلدية، دون الحصول على ترخيص بذلك من الجهة المختصة وزارة الصحة.

وحضر مرافعة العيادة المحامي الدكتور فواز الخطيب، وطالب ببطلان محضر الضبط، مؤكدا أنه يثبت بالاطلاع على محضر المخالفة الصادر بحق المتهم لإدارة منشأة دون ترخيص صادر من إدارة التفتيش الدوائي بوزارة الصحة وكانت المشكلة وفق نص القانون متابعة تنفيذ هذا القانون وضبط الجرائم والمخالفات التي تحدث بالمخالفة لأحكامه، وإصدار التقارير اللازمة، لا من اللجنة المنصوص عليها في القانون رقم 70 لسنة 2020، ومن ثم تم التوقيع على التقرير باطلاً لإصداره من قبل جهة ليست لها الصلاحية في ذلك.
